Mole in a hole ("we", "our", or "us") operates the mobile application Wacky Whale (the "App"). This Privacy Policy explains how we collect, use, and disclose information about you when you use our App.
1.1 Birthdate (Local Only)
When you use the App, we may ask you to enter your birthdate. This information is stored locally on your device and is not shared with us or any third party.
We use this information only to determine whether the user is under or over the age of 13 years:
If the user is aged 1–12 years, the App informs the ad provider that the App is child-directed.
If the user is aged 13 years or older, the App informs the ad provider that the App is not child-directed.
This mechanism is designed to comply with child privacy laws such as the Children’s Online Privacy Protection Act (COPPA).
1.2 Usage Data
We may collect limited usage data such as device type, OS version, and interactions within the App via third-party services (see below).
We use Unity Ads / IronSource to display advertisements. These services may collect certain information automatically, such as:
Device information (type, model, OS, IDFA/GAID)
Interaction data (clicks, views)
IP address (used for approximate geolocation)
The ad service uses the child-directed flag provided by our app (based on birthdate) to ensure age-appropriate content is shown.
Unity Ads/IronSource operates under Unity Technologies’ privacy practices. You can view their privacy policy here:

To display appropriate ads based on age group
To comply with legal obligations (e.g., COPPA)
To improve user experience through analytics (only anonymous usage data)
The birthdate is stored only on your local device and is not uploaded or shared. It is used exclusively within the App to configure ad targeting parameters.
We do not collect or store personal data on our servers.
We are committed to protecting the privacy of children. If a user indicates they are under 13, the App sets the "child-directed" flag for the ad provider, ensuring ads comply with children's privacy regulations.
We take appropriate security measures to prevent unauthorized access to your information. However, since no electronic transmission or storage is 100% secure, we cannot guarantee absolute security.
Depending on your jurisdiction, you may have the right to:
Access the personal data we hold about you
Request correction or deletion of your personal data
Object to certain processing of your data
Since our App stores data locally and does not collect personal data, most of these rights can be exercised directly via your device.
Our App may send push notifications to remind users to return to the game after a period of inactivity. These notifications are based on in-app behavior (e.g., the number of days since last use).
These notifications are generated locally by the App using data stored on your device (e.g., last session timestamp).
No personal information or usage data is transmitted to our servers for notification purposes.
You can opt out of receiving these notifications at any time by disabling notifications for the App in your device settings.
We respect the privacy rights provided under various U.S. state laws, including the California Consumer Privacy Act (CCPA/CPRA) and similar laws in Colorado, Connecticut, Virginia, and Utah.
Although we do not sell or share personal data in the traditional sense, we have enabled settings with our advertising partner (Unity Ads / IronSource) to apply a “Do Not Sell or Share My Personal Information” preference to all users from these states by default.
If you are a resident of one of these states, you may have the right to:
Opt out of the sale or sharing of your personal information
Request access to your personal data
Request deletion of your personal data
Because our App stores limited data locally and does not collect or store personal data on our servers, most of these rights are inherently respected.
If you have specific questions or requests, feel free to contact us using the details below.
If you are located in the European Economic Area (EEA) or the United Kingdom, you have certain rights under the General Data Protection Regulation (GDPR).
Although we do not directly collect or process personal data, our advertising partner Unity Ads / IronSource may collect and process data in accordance with GDPR, including:
Device identifiers (e.g., IDFA, GAID)
IP address (used for regional targeting)
In-app behavior (e.g., ad views or clicks)
You have the right to:
Request access to any personal data collected
Request correction or deletion of your data
Object to certain data uses, including profiling or personalized advertising
Withdraw consent at any time
